Terms and Conditions

General Provisions 

The terms and conditions outlined below apply to all orders placed via the online store of Mueski OG (hereinafter referred to as "Mueski") and to all contracts, deliveries, and other services between Mueski and customers. 

Deviating provisions shall only apply if expressly agreed in writing or in text form (e.g., email) by both parties. 

Orders

The language available for the conclusion of the contract is German. 

The contract text is not stored by Mueski. Customers can save the contract text using their browser's print function before submitting the order. 

The presentation of products in the online store does not constitute a legally binding offer but merely an invitation to submit an offer. 

By clicking the "Place binding order" button, the customer makes a binding offer to purchase the items in the shopping cart. 

Acknowledgement of receipt of the order does not constitute acceptance of the offer. A contract is only formed upon express acceptance via confirmation email from Mueski. 

Mueski reserves the right to reject any order without providing reasons. This may occur in particular if items are unavailable, previous invoices remain unpaid, the credit card check fails, or there are justified concerns regarding the customer's creditworthiness. In such cases, the customer will be informed immediately. 

If a product is permanently unavailable, Mueski reserves the right to withdraw from the contract. The customer will be informed immediately in such a case. 

Delivery and Shipping 

Delivery time is up to two weeks from receipt of the order or crediting of the invoice amount, unless otherwise specified. Customers will be informed immediately in case of delays. 

The place of performance for deliveries and other services is Mueski's business location. 

Information regarding shipping and any applicable insurance costs is provided during the order process or upon request. Deliveries are made to all EU member states as standard. Deliveries to non-EU countries are not standard and must be arranged individually. Customers from such countries are requested to contact Mueski directly before placing an order to discuss possible solutions. 

In case of returns under warranty, Mueski must be notified in writing in advance. Returns must be expressly confirmed by Mueski. Mueski assumes no liability for uncoordinated returns. 

Payment

Payments can be made by Mastercard, Visa, Maestro, PayPal, or immediate transfer. 

All prices are quoted in Euros and include statutory VAT for orders within the EU. For deliveries to non-EU countries, prices are net (excluding VAT). Any customs duties or import taxes incurred in the destination country are the customer's responsibility. 

As the offered jewelry pieces are typically custom-made or produced in small batches, prices may differ upon reordering. 

Despite careful pricing, errors may occur. Mueski verifies the price before accepting the customer's offer. If the actual price is higher, the customer will be contacted to confirm or cancel the order. 

Retention of Title 

Goods remain the property of Mueski until full payment of all claims arising from the respective purchase contract has been received. 

Liability and Defects 

Minor deviations in color, texture, or size due to digital display or the use of natural materials do not constitute defects. Product images are symbolic. 

Liability for damage caused by slight negligence is excluded—except for personal injury or damage to items submitted for processing. Statutory consumer protection provisions remain unaffected. 

Customer Obligations 

The customer is required to inspect the goods for obvious transport damage upon receipt and to report any such damage immediately. 

The customer is responsible for providing accurate and complete contact and order information and for promptly reporting any changes. 

Right of Withdrawal (Revocation) 

This right of withdrawal applies only to contracts concluded through distance selling—particularly online store or email orders. No statutory right of withdrawal exists for in-store purchases. 

Consumers have the right to withdraw from this contract within fourteen days without giving any reason. 

The withdrawal period is fourteen days from the day the customer or a third party named by the customer, who is not the carrier, takes possession of the goods. For contracts involving delivery in multiple parts or items, the period begins upon receipt of the last shipment. 

To exercise the right of withdrawal, the customer must inform Mueski (Mueski OG, Neulinggasse 18/1 and 1B, 1030 Vienna, Austria, office@mueski.at) via a clear statement (e.g., letter by post or email). 

Exemptions: The right of withdrawal does not apply to goods that are made to customer specifications or clearly personalized (e.g., engraved or custom-made jewelry) in accordance with Section 18(1)(3) FAGG. 

Consequences of withdrawal: 

If the customer withdraws from the contract, Mueski will reimburse all payments received, including standard delivery costs (excluding any additional charges for special delivery methods chosen by the customer), within fourteen days of receiving the notice of withdrawal. 

The same payment method used in the original transaction will be used for the refund, unless otherwise agreed. No fees will be charged for the refund. 

Mueski may withhold reimbursement until the goods have been received or the customer has provided proof of return. 

The customer must return the goods within fourteen days from the date of withdrawal notice to:

The return deadline is met if the goods are dispatched before the deadline. Customers bear the direct return shipping costs if the goods correspond to the order. 

Mueski will insure the return shipment only if the customer notifies Mueski in advance and receives written confirmation of insurance. 

Customers are only liable for any diminished value of the goods if this is due to handling beyond what is necessary to ascertain the nature, characteristics, and functioning of the goods. 

Data Protection 

The separate privacy policy applies. 

Disclaimer for Links 

Mueski accepts no liability for the content of external websites linked from this site. If Mueski becomes aware of illegal content on linked pages, such links will be removed immediately. 

Links to this website are permitted only as external links in a separate browser window. Embedding the main window in a frame is prohibited. 

Applicable Law, Jurisdiction, Final Provisions 

This contract is subject to Austrian law, excluding conflict of law rules and the UN Sales Convention. 

For disputes with consumers, the statutory place of jurisdiction applies. For business customers, the exclusive place of jurisdiction is Vienna. 

Mueski reserves the right to amend these terms and conditions at any time. Changes do not apply to orders already placed. 

By submitting a purchase offer, the customer agrees to these terms and conditions. 

The term "customer" refers equally to all genders. 

Should individual clauses of these terms and conditions be wholly or partially invalid, the validity of the remaining clauses shall not be affected. Invalid clauses shall be replaced by valid provisions that most closely reflect the economic intent of the original.
